These terms govern your use of RestartWorks, a service operated by Discovery Coaching, LLC ("Company," "we," "us"), located in Contra Costa County, California. By using RestartWorks or clicking to acknowledge these terms, you ("you," "User") agree to all of the following. If you do not agree, do not use the service.

1. What RestartWorks Is — and Is Not

RestartWorks is a self-improvement and educational coaching platform. It provides general educational and motivational content, self-assessment tools, and AI-generated coaching reflections based on a personal-development philosophy authored by David Killion. It is intended to help you think through your own decisions and take your own action.

RestartWorks does not provide professional services of any kind. It is not financial, investment, tax, legal, medical, psychological, or psychiatric advice, diagnosis, or treatment, and it does not create any professional, fiduciary, advisory, therapeutic, or clinical relationship between you and the Company or David Killion. All decisions you make are your own.

2. Artificial Intelligence Acknowledgment

You acknowledge and understand that substantial portions of RestartWorks — including coaching reflections, assessments, summaries, and chat responses — are generated by artificial intelligence, not by a human, and not by David Killion personally.

While we have designed the AI to reason from and respond in accordance with the philosophy and coaching framework authored by David Killion, artificial intelligence can and does make mistakes. AI-generated content may be inaccurate, incomplete, outdated, internally inconsistent, or simply wrong. It may occasionally produce statements that do not reflect what David Killion intended, believes, or would say. You should not treat any AI-generated output as a statement of fact, a professional opinion, or a recommendation to act.

You are solely responsible for evaluating the accuracy and appropriateness of any AI-generated content and for any action you take or do not take in reliance on it.

Content provided through RestartWorks is for educational and informational purposes only. It is general in nature and is not tailored to your specific circumstances, even where it may appear personalized. Specifically, and without limitation:

4. Not a Crisis or Emergency Service

RestartWorks is not an emergency service, crisis line, or suicide-prevention service, and it cannot respond to emergencies. It is not monitored in real time by humans.

If you are in crisis, thinking about harming yourself, or in immediate danger, call 911 (or your local emergency number), or call or text the 988 Suicide & Crisis Lifeline. Any automated detection or resource messaging within RestartWorks is a limited, imperfect convenience feature and must never be relied upon to identify, assess, or respond to a crisis.

5. Assumption of Risk

You expressly and voluntarily acknowledge and agree that any use of RestartWorks, and any decision or action you take in connection with its content (including financial, lifestyle, health, or personal decisions), is undertaken entirely at your own risk. You assume all risks, known and unknown, associated with your use of the service and with acting or declining to act on any content it provides, including AI-generated content that may be erroneous.

6. Release, Waiver & Hold Harmless

To the fullest extent permitted by California law, you hereby release, waive, and discharge Discovery Coaching, LLC, David Killion, and their respective owners, members, officers, employees, contractors, and agents (collectively, the "Released Parties") from any and all claims, demands, damages, losses, or liabilities of any kind arising out of or relating to your use of RestartWorks or your reliance on, implementation of, or misinterpretation of any content or perceived advice provided through it — including content generated by artificial intelligence — even where such claim is alleged to arise from the negligence of a Released Party.

This release does not apply to liability that cannot be waived as a matter of law, including liability for gross negligence, willful misconduct, or fraud. Nothing in these terms waives any right that cannot lawfully be waived under California law.

7. Limitation of Liability

To the fullest extent permitted by law, in no event shall the Released Parties be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of RestartWorks. The total aggregate liability of the Released Parties for any and all claims relating to the service shall not exceed the amount you actually paid to the Company in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; where that is the case, the limitations apply to the maximum extent permitted.

8. Indemnification

You agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost (including reasonable attorneys' fees) arising out of your use of RestartWorks, your violation of these terms, or any claim brought by a third party (including a family member or your estate) arising out of your use of the service.

Sharing

We do not sell your personal information. We share data only with service providers necessary to operate RestartWorks (e.g. hosting, payment, AI processing, email) and as required by law.

Your choices

You may request access to or deletion of your personal data by contacting us. California residents have additional rights under the CCPA/CPRA, including the right to know, delete, and opt out of sale (we do not sell data). Retention

We retain your data for as long as your account is active and as needed for legal, security, and operational purposes, including retaining records of your acknowledgment of these terms.

11. Intellectual Property

All content, frameworks, the five-pillar philosophy, assessment design, and software comprising RestartWorks are owned by Discovery Coaching, LLC and are protected by intellectual-property law. You receive a limited, personal, non-transferable, revocable license to use the service for your own personal development. You may not copy, resell, redistribute, or create derivative works from the content without written permission.

12. Governing Law & Disputes

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute shall be resolved in the state or federal courts located in Contra Costa County, California, and you consent to that jurisdiction and venue. 13. Changes to These Terms

We may update these terms. When we make material changes, we will update the version number and effective date above, and we may require you to acknowledge the updated terms before continuing to use the service. Your continued use after an update constitutes acceptance.
